California Eminent Domain Battle Looms

There is an interesting coalition of politicians and voters lining up in California to propose a ballot limitation of the powers of eminent domain in their state. They are looking to get a ballot initiative restricting local and state usage of eminent domain for private gain.
Some of the county’s predominantly left-leaning opponents of eminent domain have joined forces with a largely Republican San Jose group on a ballot drive that would restrict the taking of private land throughout the state.
Under the name Limit Eminent Domain, the group has filed a ballot measure that would prohibit local governments from taking private land for private economic benefit.
The measure — one of four eminent domain initiatives introduced for the November election — comes in response to a U.S. Supreme Court decision last year upholding a city’s authority to use eminent domain to advance a private development. Cities and states had always been able to take property for public projects such as a highway. San Francisco Examiner.
