This is a tough one, because their site is not created by CL employees, etc, but by we the community. Hence, are they really publishing anything. This is like saying the city of Phoenix is at fault for a person creating their own sign and putting on a street which violates something. No if they can capture the person who created the sign they are at fault. The city of Phoenix does not even need to look for these signs, but once they are notified they should remove them. Hence, I find this issue a waste of time if you follow the logic.
