We have many different ideas on why using eminent domain outside of its original purpose is a bad idea. We have discussed them here. But now the City of Sacramento is using eminent domain as a crime fighting tactic.
The City of Sacramento will use the eminent domain laws to buyout and relocate a couple of Oak Park businesses it considers a public nuisance. The businesses are the Washington Market, and Day’s Market.
Neighbors complain the stores are magnets for crime and neighborhood problems. The city council heard from those neighbors Tuesday night who said they witness prostitution and drug deals near the liquor stores on a daily basis. via CBS 13/UPN 31
There are two liquor stores that attract what the Sacramento city officials call an undesirable element. So instead of using the police effectively, they want to make the problem go away. Now they could buy out the stores by making a fair and compelling offer to the owners of the stores. But that would be ethical.
Instead, they are using the Eminent Domain laws to take the property from the owners. The power of the sheriffs gun to remove the businesses and take their livelihood at a price they may not want to sell at.
And that is the biggest problem with eminent domain laws today. They empower a government with our private property rights. And the government never lives within the original boundaries set for them.
