Eminent Domain – Who Owns Your Property?

The battle over eminent domains place in our society has been raging since the Supreme Court’s Kelo decision. After watching it fairly closely I am almost thankful that we are able to see the battle as it is telling me who stands where on the most important issues out there.

Who owns your land and property?

Many politicians see all of the property in the country belonging to the government. They think they determine what taxes should be, and then rebate the rest for you to live on. This is not uncommon, it was the basis for feudal society for thousands of years. But America is not a feudal society. We are a Democratic Republic.

Land and property belong to the individual. We by the rights of the constitution are required to be taxed on our earnings to support a limited government. That is all. The founders gave the right of the government  to buy property through eminent domain for projects that were designed that the government needed to accomplish such as schools, military bases,  road.

Now many politicians want the right  to take your property because you are not using it within the way they would like you to. Who do they really think owns your property? My guess is that in these politicians minds, they do. They are the politicians that control their region, they are the bosses. You work for them.

So they see the  opportunity for government to take property from you to build something in their minds will improve their city. These  politicians see construction contracts to create jobs for their constituents, new tax revenue to be spent for political gain.

What these politicians fail to see is that the property belongs to you, the citizen of the United States. They see the property falling under there power. And that  is wrong.

So when you see a local politician, ask them where they fall on the eminent domain issue. If they say that your right to property is an important foundation to our society, help them get re-elected.

If they say anything else, fight like a junk yard dog to get them out of office. They are the ones that believe  your property is theirs, and you will be forever in competition with them to keep your property from being taken.

  2. Eminent Domain issues are certainly interesting, but I imagine more people will be affected by tax liens on their land over the coming years. With the large run-up in prices, many have or will soon find a big uptick in their tax bill. That’s when things start to get really interesting. My $0.02
