California Approve Eminent Domain Restrictions - Prop 99

Congratulations to the voters in California for passing Proposition 99. The new ordinance will keep developers and those politically connected from using state and local governments in California from seizing properties in their name.
I have no problem with eminent domain being used for public projects. That is the role of it as long as homeowners are fairly compensated. But the recent use of the term blighted property that allows governments to take property that they then pass on to developers is morally bankrupt.
A more restrictive Proposition 98 lost that was focused on rent control with a tough eminent domain policy, but that is okay. My bet it was on the ballot to provide a contrast for voters to see the levels of government intervention.
California voters should be commended for their vote yesterday.
The less restrictive Proposition 99, the Homeowners and Private Property Protection Act, prohibits government agencies from using eminent domain to take an owner-occupied home and transfer it to a private owner or developer.
The proposition also allows homes to be seized to protect public health and safety, deal with criminal activity or in an emergency. via the San Jose Business Journal
